Terms of Service

These Terms of Service ("Terms") govern your access to and use of the pageflare CLI tool, Cloud platform, website, and related services (collectively, the "Service") operated by pageflare ("we", "us", or "our"). By using the Service you agree to these Terms.

1. Definitions

"CLI" means the pageflare command-line tool distributed via npm, Homebrew, curl installer, or Docker image.

"Cloud Platform" means the hosted optimization service accessible at pageflare.dev and its API.

"License Key" means the token that activates Pro or higher-tier features.

"Content" means the HTML, CSS, JavaScript, images, and other files you submit to the Service for optimization.

2. Account and Access

The free tier of the CLI does not require an account. Pro and Cloud features require registration and a valid License Key. You are responsible for keeping your credentials and License Key confidential. One License Key may be used by one individual or on one CI pipeline at a time, unless your plan explicitly permits additional seats.

3. Acceptable Use

You may use the Service to optimize static sites that you own or are authorized to modify. You agree not to:

• Reverse-engineer, decompile, or disassemble the CLI binary beyond what applicable law permits.
• Share, redistribute, or sublicense your License Key to third parties.
• Use the Service to process content that violates applicable law or infringes third-party rights.
• Circumvent usage limits, rate limits, or access controls.
• Use the Cloud Platform to store or distribute content unrelated to site optimization.

4. Your Content

You retain all rights to your Content. When you use the Cloud Platform, you grant us a limited, temporary license to process your Content solely for the purpose of performing the optimizations you request. We do not store your Content beyond the duration of the optimization run unless you explicitly enable caching or artifact retention.

The CLI processes your Content entirely on your own machine. No Content is transmitted to our servers when using the CLI, except for license validation requests that contain no site data.

5. Subscriptions, Billing, and Refunds

Paid plans are billed monthly or annually as selected at purchase. All fees are in USD and non-refundable except as required by law, or if you cancel within 14 days of initial purchase and have not exceeded the free-tier usage limits during that period. We may change pricing with 30 days' notice; the new price applies at the start of your next billing cycle.

If payment fails, we will retry for up to 7 days before downgrading your account to the free tier. Unused monthly optimization runs do not roll over.

6. Free Tier and Trials

Free-tier and trial access may be modified, suspended, or discontinued at any time. We will provide reasonable notice when possible. No credit card is required for free-tier or trial usage.

7. Service Availability

We aim for high availability of the Cloud Platform but do not guarantee uninterrupted service. The CLI operates locally and is not dependent on our servers for core functionality (only for license validation). Scheduled maintenance will be announced in advance when possible.

8. Intellectual Property

The Service, including the CLI binary, Cloud Platform, documentation, and branding, is owned by pageflare and protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will produce error-free output or achieve any particular performance score for your site.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your Content, or your violation of these Terms.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access for violation of these Terms or for non-payment, with notice where practicable. Upon termination, your License Key will be deactivated and access to Cloud Platform features will cease. Sections that by their nature should survive termination will survive.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the email associated with your account or through the Service. Continued use after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which pageflare is incorporated, without regard to conflict-of-law principles.
